Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of The Nice List (the “App”), provided by us (“we”, “us”). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.

These Terms apply together with our Privacy Policy, which explains how we handle your data.

You must be at least 13 years old (or the age of digital consent in your country) to use the App. By using it, you confirm you meet this requirement and that you have the legal capacity to agree to these Terms. The App is intended for personal, non-commercial Christmas planning.

• You are responsible for keeping your sign-in details secure and for all activity under your account.
• You must provide accurate information when registering and keep it up to date.
• Notify us promptly of any unauthorised use of your account.
• One account per person; do not share your account with others.

You are responsible for the information you enter (recipient names, interests, gifts, budgets, notes, and messages to the E.L.F. assistant). You confirm that you have the right to store any personal data of others you add (for example, a recipient’s interests) and that you do so in accordance with applicable data protection law. We process that data on your behalf as described in our Privacy Policy.

You grant us a limited, non-exclusive licence to use your content solely to operate, provide and improve the App and its features for you. We do not sell your personal data.

You agree not to:

• Use the App for any unlawful, harmful, fraudulent or infringing purpose.
• Attempt to gain unauthorised access to the App, other accounts, or our systems.
• Interfere with or overload the App, or use it in a way that could damage or disrupt it.
• Enter content that is unlawful, defamatory, or that infringes someone else’s rights.
• Use automated tools to scrape or extract data from the App.

The App includes an AI assistant, E.L.F. (Expert List Finder), which generates gift suggestions based on your data. AI output is provided for inspiration only and may be inaccurate or unsuitable. You are responsible for checking any product, price, link or suggestion before relying on it or making a purchase. We do not guarantee availability, pricing or suitability of any suggested item.

The App may reference or link to third-party stores (such as Amazon). We do not control and are not responsible for those sites, their content, prices, products, or their privacy practices. Any transaction with a third party is between you and that third party, and separate terms will apply.

The App is currently free to use. If we introduce paid features, we will notify you and set out the applicable fees and terms before you are charged. We may change or discontinue features, but any fees you have already paid for a period will not be affected for that period.

We own or licence all rights in the App, including its design, code, branding and content (excluding your content). These Terms grant you no rights to our intellectual property except the limited licence to use the App as intended. “The Nice List” and related marks are our trade names.

We aim to keep the App available but do not guarantee uninterrupted or error-free access. We may update, suspend or discontinue the App, features or content at any time, with or without notice. We are not liable for any loss arising from downtime, maintenance, or events beyond our reasonable control.

The App is provided “as is” and “as available”. To the fullest extent permitted by law, we exclude all warranties, conditions and terms, whether express or implied, regarding the App, including any warranty of accuracy, reliability, fitness for a particular purpose or non-infringement.

To the fullest extent permitted by law, we are not liable for any indirect, incidental, consequential or loss-of-profits damages arising from your use of, or inability to use, the App. Our total liability for any claim arising out of or relating to the App is limited to the amount you have paid us in the twelve months before the claim (or £100 if you have not paid us anything), unless the liability arises from our negligence causing death or personal injury, fraud, or any other matter that cannot be limited by law.

You agree to indemnify and hold us harmless from any claims, losses or damages arising from your breach of these Terms, your misuse of the App, or your violation of any law or third-party rights.

You may stop using the App and close your account at any time. We may suspend or terminate your access if you breach these Terms, misuse the App, or if we reasonably believe doing so protects the service or other users. On termination, your right to use the App ends, but these Terms will remain in effect to the extent needed to give them effect.

We may update these Terms from time to time. We will post the revised version here with an updated date and, for material changes, notify you within the App. Continued use after changes take effect means you accept the updated Terms.

These Terms are governed by the laws of England and Wales. Any dispute arising out of or relating to them or the App will be subject to the exclusive jurisdiction of the courts of England and Wales, except where you are a consumer with a mandatory local right to bring proceedings in your own country.
